4.1 Sanitary and phytosanitary (SPS) measures
This measure (Chapter X, Para 22 (a) and (f) thereof) provides for an import prohibition of products that are toxic or poisonous and dangerous to the health of the consumers and, if the product falls under one of the situations enumerated by the provision, the prohibition applies. This measure also applies to domestic production, exportation, and distribution of food products. The specific limits that apply are those of Codex Alimentarius. The objective of the measure is to ensure food safety.

4.1.1 Prohibitions and restrictions of imports for SPS reasons
This measure (Chapter 6, Article 12 (b) and (c) thereof) provides for an import prohibition of animals, animal products and animal feed that can pose health risks. If the imported animals are found to be infected with a contagious disease, or the animal products or animal feed are found to not meet the standard quality or contain harmful pathogens or toxins, the animals, animal products and animal feed transported into the country may temporarily be detained, and be subject to re-transportation or destruction. The contagious diseases, harmful pathogens, or toxins are those prescribed by the OIE or the FAO Codex. The objective is to prevent the outbreak of contagious diseases in animals, to control the outbreak systematically when it occurs, to inspect in the prescribed manner to ensure that the animal is free from contagious disease, and that the animal product or animal feed is of standard quality and free from harmful pathogens or toxins.

4.1.1.3 Systems approach
This measure (Articles 18 and 25, in combination with Articles 2(i), 2(j) and 2(k) thereof) provides for a number of general requirements regarding food safety and labelling for food safety purposes in food products imported into the territory of Myanmar. More specific requirements are to be adopted in separate legal instruments.The objective of this measure is to ensure the genuine quality, safety, hygiene of food and to prevent the public from consuming food that may cause danger or injury to health.

4.1.1.3 Systems approach
This measure (Articles 10, 12 (a) and (d), 13 thereof) provides for a system of controls, inspections, certification and recommendation for the importation of live animals and/or animal products and animal feed into the territory of Myanmar. This measure (Chapter 8, Article 29 (c) and Chapter 10, Article 35 thereof) provides for an authorization requirement for the import of aquaculture products. 4.1.1.4 Special authorisation requirement for SPS reasons
This measure (Chapter 3, Article 4 (a) and Chapter 6, Article 11 thereof) provides for the requirement to obtain authorization from the relevant agency related to the importation of plants, plant products, pests, beneficial organisms or soil. Any such product may only be imported after the issuance of an import certificate by the Myanmar Agriculture Service (now referred to the Plant Protection Division under Department of Agriculture), which is a precondition to obtain a license or permit from the relevant department or organization. 4.1.1.5 Registration requirements for importers
This measure (Chapter 4, Paragraph 4.1.2 thereof) provides for registration requirement for importers.Establishments, companies or individuals that intend to import fish and fishery products to Myanmar shall obtain and maintain a valid Registration for this from the Ministry of Commerce according to administrative procedures stipulated by that ministry. The objectives of this measure are to keep consumers safe, to produce qualified fishery products, to comply with the international regulations, and to support the establishment of the ASEAN Community.

4.1.2.1 Tolerance limits for residues of or contamination by certain (non-microbiological) substances
This measure (Chapter 10, para 22 (d) thereof) provides for tolerance limits for residues of certain substances in food. The measure prohibits the imported food to contain agricultural chemicals in excess of the maximum permissible level determined by the responsible authority. 4.1.2.1 Tolerance limits for residues of or contamination by certain (non-microbiological) substances
This measure (Chapter 4, Paragraph 4.5 thereof) provides for additional requirements for import of aquaculture products including live fish. 4.1.2.2 Restricted use of certain substances in foods and feeds and their contact materials
This measure (Chapter 10, Para 22 (c) thereof) provides for a restriction or prohibition on the use of certain substances contained in food. The measure restricts or prohibits the imported food in which certain food additives are used in excess of the prescribed limit. The specific limits are referred to the FAO Codex. The objective of this measure is to ensure food safety.

4.1.3.1 Labelling requirements
This measure (Chapter 10, Para 22 (h) and (i) thereof) provides for a labelling requirement concerning information directly related to food safety. The measure prohibits the import of food, when the label wrongly lists an ingredient not included in the food product and when the label does not include the information required to be provided, as determined by the relevant government department or organization which is authorized to issue the license. The objective of the measure is to inform the consumer about the food safety of the product.

4.1.3.1 Labelling requirements
This measure (Chapter 1, Article 2 (k-3) thereof) provides for labelling requirements for iodized salt which is produced, imported, stored and sold. The iodized Salt package or container shall mention: (a) the apparent word of ??Iodized salt??, (2) manufacturing plant/logo, name and address of the manufacturing plant, (c) net weight, (d) components such as KIO3/KI and the amount/percentage of components (e) manufacturing date and expired date, (f) lot identification code, and (g) storage instruction. 4.1.3.1 Labelling requirements
This measure (Chapter 2, section 2.2.3.20 and 2.2.3.21 thereof ) provides for a labelling requirement concerning the imported compound feed intended for aquaculture animals.The labelling of compound feed intended for aquaculture animals shall include at least (a) commercial Name and unique product code (if it exist);(b) type of feed (??complete?? or ??complementary??) and target aquatic animal (for example indicated as ??complete feed for freshwater fish??); (c) Registration number or other unique ID number and name and address of thefeed business operator under which name the feed is placed on the market;(d) Name and address of the feed business operator that imported/placed theproduct on the market (where relevant);(e) batch or lot reference number; (f)net quantity per package unit; (g)general instructions for proper use; (h) the minimum storage life indicated as ??use before date?? or ??best before date??; (i)composition by feed ingredients (materials) in descending order; (j) feed additives expressed in amount per kg or amount per liter; and (k) thefunctional substance(s) and the content of the substance ) if any pharmacological active substance is included in the compound feed. Additionally, (a) the information about the Importer name and address and, when necessary, a
translation of the information on the label to Myanmar or English language; and (b) information about approval/listing by the competent authority of thecountry inwhich the feed is produced shall be provided in separatedocument if not directly on the label. 4.1.3.3 Packaging requirements
This measure (Chapter 1, Article 2 (k-2) thereof) provides for packaging requirements for the iodized salt which is produced, imported, stored and sold. A large sized package (from 3 viss to 50 viss), shall be packed securely with at least 2 layers of bags. The inner bag must be high density Polyethylene and the outer bag must be woven polypropylene bags or non-porous material. 4.1.6.4 Storage and transport conditions
This measure (Paragraph 4 of the Regulation for the Importation of Cattle and Buffalo into Myanmar) provides for a requirement for which the imported cattle and buffaloes should be transported. After being released from the quarantine station and the litter cleaned and disinfected, the animals are to be transported in sealed lorries/trucks to the approved farms under veterinary supervision. 4.1.6.4 Storage and transport conditions
This measure (Paragraph 4 of the Regulation for the Importation of Horses into Myanmar, Paragraph 4 of the Regulation for the Importation of Sheep and Goats into Myanmar, Paragraph 4 of the Regulation for the Importation of Breeding Swine into Myanmar) provides for a transport requirement for the import of horses, sheep and goats as well as breeding swine into Myanmar.The vehicle and containers for transporting must be thoroughly cleaned and disinfected and designed to avoid injury. 4.1.6.4 Storage and transport conditions
This measure (Chapter 1, Article 2 (k-3) thereof) provides for certain conditions and requirements under which imported or manufactured iodized salt should be stored and transported. In order to maintain the product quality, iodized salt stored / transported shall (a) not be exposed to direct sunlight, (b) not be exposed to high temperature and relative humidity, (3) not be directly exposed to rain or to water/ the soil/ground, (4) not be exposed to contaminated environment, and (5) be sold through a first-in first-out system. 4.1.7.1 Product registration requirement
This measure (Chapter 4, Para 31, b and d thereof) provides for a requirement that the product must be approved before it may be imported. A trader who has obtained the relevant business license and intends to import seed products is required to apply for a recommendation certificate to the Technical Seed Committee by submitting the copy of the seed quality recommendation and the Phytosanitary certificate as attachments. 4.1.7.2 Testing requirements
This measure (Chapter 1, Article 7 and Chapter 2, Article 16 thereof) provides for a testing requirement of imported animals, animal products and animal feed. Any trader who intends to import animals, animal products or animal feed is required to allow the responsible agency to test the animals, animal products and animal feed. 4.1.7.2 Testing requirements
This measure (Directive No. 9/2014 thereof) provides for the requirement for a product to be tested. Companies that intend to import raw fish are required to apply for are commendation (SPS certificate) from the Department of Fisheries and are required to send a sample of the raw fish to be imported for laboratory testing prior to the importation. The specific criteria are based on the relevant international standard under the FAO Codex. The objective of this measure is to ensure food safety.

4.1.7.2 Testing requirements
This measure (Paragraph 4 of the Regulation for the Importation of Beef, Mutton and their Edible Products into Myanmar, Paragraph 4 of the Regulation of Importation of Hatching Eggs, Poultry/ Birds into Myanmar, Paragraph 4 of the Regulation for the Importation of Breeding Swine into Myanmar, Paragraph 4 of the Regulation of Importation of Horses into Myanmar, Paragraph 4 of the Regulation of Importation of Sheep and Goat, Paragraph 4 of the Regulation for the Importation of Dogs and Cats into Myanmar) provides for the inspection requirement in Myanmar for the importation of beef, mutton, and their edible products, as well as eggs, poultry/birds, swine, horses, sheep and goat, dogs and cats. The animals and meat/meat products are subjected to the inspection of laboratory testing upon arrival. The objective of this measure is to prevent the importation of diseases.

4.1.7.2 Testing requirements
This measure (Chapter 4, Paragraph 4.3.2.c and 4.3.8 thereof) provides for sampling and testing on aquaculture products, including live fish, for compliance with Myanmar food safety criteria. This may include sampling and testing for compliance with organoleptic, chemical and microbial quality and food safety criteria such as (1) one of each ten consignments from the same supplier if it is raw, low risk products for cooking before consumption, (2) one of each two consignments from the same supplier if it is high risk products ready to eat (cooked products, histamine sensitive species, cooked dried shellfish) (routine schedule), and (3) samples from ten consecutive consignments from the same supplier if results of previous sampling and testing from that supplier showed non-compliant results (sampling on suspicion). This measure (Chapter 2, Para 3 and Chapter 4, Para. 31 (e) thereof) provides for a certification of conformity requirement that any importers who want to import new plant variety and seeds to meet. The importers should obtain import permission from the National Seed Committee by submitting documents including the original SPS certificate issued by the exporting country relevant authority, the seed sample, copy of seed quality certificate to the National Seed Committee. 4.1.7.3 Certification requirement
This measure (Paragraph 3 of the Regulation for the Importation of Wildlife as Zoo Animals into Myanmar) provides for the requirement of a veterinary health certificate for the import of wildlife as zoo animals into Myanmar stating the health status of the animals, information that the country of origin has been free from FMD, Rinder pest, Anthrax, Fowl plague, Newcastle Disease, Contagious Bovine/ Caprine Pleuro-pneumonia, African Swine Fever, African Horse Sickness and Rabies, that the animals or birds originate from areas where there has been no clinical evidence of CBPP, Malignant Catarrhal Fever, Brucellosis, Tuberculosis and John's Disease Ovine (for Bovine), Brucellosis, CCPP (Contagious Caprine Peuropneumonia) (for Caprine), Glanders and Equine Encephalomyelitis (for Equine), Pullorum, Infectious Laryngotracheitis, Avian Influenza (for avian), Distemper, Rabies &Panleukopenia (Canine/Feline), Tuberculosis (for primate), Rabies, Influenza (for other species), Leptospirosis, Brucellosis, Chlamydophila psittaci, Phocid herpes virus, Calciviruses, Canine Adenovirus (for sea lion). The objective is to prevent the importation of diseases.

4.1.7.3 Certification requirement
This measure (Paragraph 3 of the Regulation for the Importations of Sheep and Goats into Myanmar) provides for the requirement of a veterinary health certificate for the import of sheep and goats into Myanmar stating that the animal is free from any infectious or contagious diseases, that the animal originates from an area free from FMD, Rinder pest, Contagious Bovine Pleuropneumonia - CBPP and Contagious Caprine Pleuropneumonia - CCPP, that the animal is tested with Complement Fixation Test for CBPP and CCPP, that the animal comes from farms where there has been no clinical evidence of Brucellosis for the preceding six months prior to export and tested with Complement Fixing Test for Brucellosis. 4.1.7.3 Certification requirement
This measure (Paragraph 3 of the Regulation for the Importation of Pork and their Edible Products into Myanmar) provides for the requirement of a veterinary health certificate for the import of pork and their edible products into Myanmar. The certificate should provide detailed facts of the commodity, information that the country of origin is free from Rinder pest, African Swine Fever, Enteroviral Encephalomyelitis and Swine Vesicular Disease, Foot and Mouth Disease (FMD) and Porcine Respiratory and Reproductive Syndrome (PRRS), that the farm is free from infectious and contagious disease notifiable in the country of origin, information of inspection, testing, processing, storing, labeling.The objective is to prevent the importation of diseases.

The certificate should provide for Pedigree certificate, infection or contagious disease, evidence that the country of origin is free from African Horse Sickness, Equine Encephalomyelitis, Vesicular Stomatitis, Dourine, and Epzootic Lymphangitis, Equine Infectious Anaemia, Equine Viral Arthritis, Equine Rhinopneumonitis, Equine Influenza and Horse Pox, Glanders, Strangles and Surra, quarantine of exporting country, testing result for Equine Infectious Anaemia, African Horse Sickness, Equine Viral Arthritis. The objective is to prevent the importation of animal diseases.

4.1.7.3 Certification requirement
This measure (Paragraph 3 of the Regulation for the Importations of Hatching Eggs, Poultry/Birds into Myanmar) provides for the requirement of a veterinary health certificate for the import of hatching eggs, poultry/birds into Myanmar. The certificate must contain a detailed information of the animals, Pedigree certificate, the hatching egg of Day of Chick (DOC), the evidence of the origin free from Fowl plague, Salmonella pullorum and Highly Pathogenic Avian Influenza, Avian Encephalomyelitis, Egg-drop Syndrome (EDS), Parvo Virus Infection Infectious Anaemia and Ornithosis. 4.1.7.3 Certification requirement

4.15.5 Export taxes and charges
